hmmmm 
I have found the problem:
I downgraded the transcode rpm to 
[root@kyle 4]# rpm -q transcode
transcode-0.6.14-1.1.fc3.rf

This one is from the freshrpms repository
transcode-1.0.0-0.1.beta3.2.fc4

It has nothiong to do with subtitles but the solution is the same as a
post in the archives. I can encode again.
